Over the past 10-15 years the industry has seen a substantial increase in data sharing prompted by data science. Data sharing, and the contract clauses that address the topic, used to be well-established and unlikely to lead to large scale litigation with how the data used to be collected, stored and analyzed. But now, things have changed. There is a massive torrent of data flying around between institutions (and commercial entities) for secondary use, and too many institution contracts & compliance offices have not updated their decades-old contracts, leading to mistakes in vetting their rights to use the data and using the wrong templated contracts to share data. After observing this trend, our speakers created a road map of the hidden obstacles & risks that are not being properly addressed, potentially pointing us toward mass litigation in the coming years if not corrected.
